Serious question. Did the court find that she was unconscious and never gave consent or that because she was inebriated her consent was not valid?

The judge said he came to the decision of a lighter sentence because the perp didn't have a criminal history and was remorseful. Nothing about the woman being able to give consent or not.

I'd say that too, but we can't act like Joes from all walks of life aren't benefitted by the privilege of being male when it comes to this particular offense. It's white male privilege. It's male privilege. It's Misogyny. It's the workings of the good ol boy network with the judge having ties to the school.

Banks' story is an unfortunate one to say the least for him and men like him who have been falsely accused, which speaks to the broken justice system, especially as it relates to black men. But what also can't be overlooked is that so many who women are victims of reported rapes and sexual assault experience the accused failing to be prosecuted, convicted or have a situation like this swimmer who ended up with probation or getting a lesser jail sentence.

You know that's rare when the accused is black. If this was a black swimmer his ass would be grass. Road to Angola (if in Louisiana).
 
Sh!t like this makes a person's blood boil when compared to the Marcus Dixon sentencing. Although the Georgia Supreme threw out Marcus Dixon's 10-year prison sentence, he had already spent 10 months in jail for having consensual sex with a 15 year old classmate. Marcus Dixon stayed in jail 9 months longer or 2.5 times longer than this azzhole will.

You're right.

Just can't also forget that recently claims of schools and coaches and police departments have surfaced everywhere from Tennessee to Morehouse alleging prominent individuals at those entities attempting to either silence alleged victims or go out of their way to protect the accused.

When people talk about what happened at Baylor being a football problem, they forget rape and violence against women had been a problem school-wide. It's just that everyone focused on the football team because it was the football team.

All of this is just symbolic of rape culture and a legal system that often mishandles these case either for the victims and for those who don't look like a Stanford swimmer.

Right. I have had some former friends who've been to jail for rape....they got thrown under the jail and got "tore out the frame" while they were in there.....and they raped Black girls. One was a Black teenager. Every Black offender I know got just what he deserved. OJ is the only Black man I've ever seen with privelege in a court room.
 
It's not just rape cases that are being mishandled. It's every type of case a person can think of. The legal system in this country is definitely not blind and too many times the laws in the legal system do not agree with the scientific laws of nature, which completely makes the legal system way out of order. IMO, lawyers need to be trained to think more analytical. It's bad when a first year college science or engineer student can do math and science that some judges don't understand, which a lot legal cases require (math and science) in order to be solved.

Let's be honest with it all....athletes are treated differently especially if they are a star. All of our universities are guilty of cover ups to preserve an image. Yet, now with so mush media scrutiny and technology it's hard to cover it up.

I'd say media influence can have an impact on the perception of a person.

But not in this case. A jury found the swimmer guilty. But the crooked ass judge game him a light sentence.

Even though the media didn't influence the jury, they could have influenced the judge's decision. If you watch the video in the link below, the media tried their best to help his azz out. And the media along with the police is just now releasing his mugshot. Before now, they chose to show him as some clean cut White boy. Like the legal system, logic is also not the case when it comes to the media. The entire system is bias. Math and science is the only non-bias subject there is and sometimes they get distorted in order to please certain people.
