JSU Seeks Legal Action Against Grambling, SWAC...

JSU here is what you do why don't you have Grambling come to you this fall on their buses and and stay in the hotels and then allow them to show up to the stadium on Saturday and then say you all are not going to play the game and call it even :lmao:...otherwise you all can forget getting what you all believe you are due for this no show!

And risk their chance of not making it back to the SCG with Mudbone. That's like giving Alcorn a free pass to the SCG.

So what was it then if it wasn't a strike? What makes them "unionized"? Keep in mind, the players hadn't practiced the week going into the game. The strike didn't just start when they decided not to get on the bus.
It was a boycott or revolt. They aren't unionized because they haven't gone through the process of forming a union and taking all necessary steps to operate and exist with officers, dues paying members, etc.... Northwestern U. Football team is trying to sue for the right to do so.

No, we were mad when the game was canceled. Even a financial settlement won't make up for having our homecoming ruined. Whatever happens now is just business.
n

Your homecoming could have just as easily been ruin by a storm that day and you all still would not have gotten the money you expected to get...Grambling had no control over those getting those kids on that bus I don't see this being a winnable case in court...Gram offer them $200k and pay them in installments!

Exactly!

So your telling me the difference between a "strike" and a "boycott" is that the players have to be "unionized" through a legal process in order for it to be classified as a "strike"?...otherwise it's just a boycott?

Besides, and believe me these are honest questions, because it seems as if hairs are being split. We debating "strike" vs. "boycott".

With that said the contract reads:

Signed by both university presidents, the contract covers all athletic events between the two schools during the 2013-14 school year. It says neither party will be held accountable for loss or damages due to causes beyond its reasonable control including, but not limited to, “acts of God, strikes, epidemics, war, riots, flood, fire, sabotage, terrorist activity or threat, closure or congestion of airports, order or restriction by any government authority or any other circumstances of like character.”

The language reads, "...including, but not limited to.....strikes". If it's not limited to strikes, couldn't it include "boycotts"?

It's as simple as this. Gram was under contract to bring a football team to Jackson to play a football game. They didn't do it. It only takes 11 to play. More than that showed up for the bus to go to Jackson. There was a football team available to go play. Not ideal, but NBA teams will go with 6 players when they should have 6 more. Gram had a team. Chose not to go play.

As for scheduling Gram for Homecoming this year, what does that do for last year??? Not a damn thing. Last year is lost unless somebody comes out of pocket. Money made for homecoming 2014 will be for 2014.

Of course... but how many games would grambling have to give to JSU in order to recoup the loss of that game? Jayrob brought up homecoming and I made my statement. An extra home game is an extra home game. You could have GSU come there the next 4 years (2 extra home games) and it could rain/snow/etc and you could still not make up for 2013 financially.

I'd say no. And I continue to submit that gram had a team that coulda come to Jackson.

True... I suspect that this will be a major point made if the case ever gets before a judge or arbitrator. 22 = offense and defense. I would never play a D1 game with 22 players but technically you only need enough to cover every position on offense and defense.

That would be fine. All we want is a good faith effort. One home game does not equal homecoming. The letter does not even state of those 20 donors who were giving $25K ever actually gave us the money in good faith. That's $500K right there.

If they decided not to give that money because the game was cancelled, they were never going to give yall that money. LOL

The players did go on strike. This will be interesting in court.

Hmm from what i have read on:

A boycott occurs when people refuse to patronize a entity, buy their product or use their service for whatever reason. A strike is when people refuse to work, usually over a contractual dispute.

This will be no easy case.

Also GSU did not take the 2017 date from JSU, the SWAC did so that isn't a GSU problem.

That's one of the reasons the SWAC is a recipient of being sued.

It also stated in the article that Sharp threatened to fine JSU for making comments towards him he didn't like about not coming to Jackson like he promised to do.:smh:

No, it was due to reason's beyond the university's "reasonable" control.

If Grambling can't exercise "reasonable" control over their own program, then why even enter into an agreement in the first place? Using your standards there can never be a breach of contract.

A single event "Beyond reasonable control" does not mean they do not have control over the program.

If this was about the program, I would agree with you. But Grambling couldn't make those PLAYERS go to practice or get on the bus. Doing so would infringe on the rights of those kids would it now? You guys simply can't ignore that part.

Yale really grasping at straws with this Grambling couldn't control those kids or it was beyond their reasonable control. Funny how easily they were controlled days later.

G, you can call their actions whatever you want. They are both a form of protest but student athletes ain't striking. And trying to qualify it within the meaning of that contract ain't gonna work.

There's going to be a lot of mad people on here when they find out this lawsuit won't go the way that they think it should.

I won't be mad either way. I am just happy that Jackson State has leaders who are not afraid to stand up for us.

Reasonable in who's mind? Doug's?

...and trust me, i am not trying to reason with you, j4l and MH and the newest hater.. Sting. I am just glad to see this matter get the attention it needs. I hope ESPN shows up in Jackson next year when it's time for the game. Im shole gonna send them an e-mail to remind them..

See...this is why I didn't want to get too deep into this. You mean the right of those kids to put the program and school in harms way by not living up to their scholarship agreement? If that "right" exists somewhere in the law I'm not aware of it.

Grambling cannot separate themselves from the actions of their football players. If you think they can you're wrong. Simple as that.

The contract statement that includes the word "strike" is open ended, though.

I can't believe all the people here defending this mess on Grams behalf.
We showed up ready to play but JSU is the bad guy.

This is priceless. :lmao:
