SAN FRANCISCO, California (CNN) -- California's Supreme Court Wednesday refused to stop the execution of convicted killer Stanley "Tookie" Williams, the founder of the Crips street gang who became an anti-gang crusader while on Death Row, a court spokeswoman said.

Williams' attorney, Jonathan Harris, told CNN he was disappointed by the court's 4-2 decision.

But Harris said he plans to make a compelling case before Gov. Arnold Schwarzenegger or his staff at a December 8 clemency hearing to commute Williams' sentence to life in prison without parole.

Schwarzenegger or a federal court could still intervene to stop the execution of Williams, who would turn 52 December 29.

The defense petitioned the high court November 10 to reopen the case.

Williams' lawyers alleged there was faulty testing of shell casings found near the scene of a triple slaying at a motel in 1979, said Natasha Minsker, director of death penalty policy for the American Civil Liberties Union.

She called the forensic evidence used in the case "junk science."

The defense also contended informants lied to prosecutors and sought to re-examine other evidence, she said.

Williams, who is scheduled to die by injection December 13, was convicted in the 1979 killings of four people. The first victim was a 17-year-old Los Angeles convenience store clerk.

Williams also was convicted of killing an immigrant couple and their daughter while stealing cash from their motel. Both cases were handled in a single trial, and he was sentenced to death in 1981.

After his imprisonment, Williams denounced gang violence and began writing children's books with an anti-gang message, donating the proceeds to anti-gang community groups.

He said he was trying to prevent young people from making the choices he did, which led to a life of crime.

"The only thing that I was doing was destroying my own kind," Williams said in an interview from his cell at San Quentin State Prison.

Actor Jamie Foxx portrayed Williams in a 2004 made-for-television movie, "Redemption: The Stan Tookie Williams Story."

On Tuesday, Virginia's governor spared the life of Robin Lovitt a day before he was to become the 1,000th person executed in the United States since capital punishment resumed in 1977. (Full story)

Lovitt's sentence was commuted to life in prison without parole for stabbing a man to death with a pair of scissors during a 1988 pool hall robbery.

Interesting post......many people have been lobbying in his favor. I have received a lot of mixed perspective as to whether he should be spared. He has definitely used his time wisely and become an asset as opposed to a liabilty. IMHO, his life should be spared but with no possibility of parole ( I know many will disagree).

First let me say this...I believe in the death penalty. I don't believe in Life in Prison because he defeats the purpose of prison which is rehabilitation. Now I know someone is going to say as a Black Man I should not be for the death penalty but hey this is America and I an entitled to believe in, what I want.

Secondly, when privatization took over the penal system it became big business; and really no one actually gave a dayum about rehabilitation.

This man has unleashed a group that has taken so many of our young brothers away.

Im in the middle about him being sentenced to death. Im in the process of reading his book. It seems like he has changed his life around.

Yes...but he rehabilitated inside a prison....To me if you are rehabilitated then you should be able to function outside of prison....to me someone with life in prison is serving no purpose.

Well, why not let him out for a spell and see how he functions? Car dealers let you test drive a car to let you see how it handles, music shop dealers let you hear samples to give you an idea of the cd, restaurants owners let you test foods to give you an idea of their product, etc............

Is he not serving a purpose to the youth currently while in prison?

Yes he is. He transformed prison time and hard labor to bring peace among gangs and inform kids about gang violence by writing childen books "IN PRISON." Brotha's that are free are not doing that, as well leaders in the black community is not doing a good job. We have 50 cent that profits from stating how many holes he will put in a Ni**a (bragging about slaying his own people) and he make money and show off his wealth that send a message to our youth and other grown and simple minded minority men and women that if we want to do it big we got to be like 50 cents. And on the hand you have the creator of the Crypts gang did commit murder that was WRONG but denounced his wicked ways and is now telling kids to love one another is about to catch the lethal injection. I am moving to Canada!!!!! LOL

Good Post!

I have to agree with Nupe on this one. I do favor the death penalty. I do not like how it has taken 20 yrs of TAXPAYERS' money for it finally to come to this discussion of either putting him under or not.

Granted he has done some good and has seemed to rehabilitated his life, but I must defer to the old saying: "Do the crime, do the time". He knew when he committed his crimes what the reprecussions were if - when he got caught. These are just the crimes that we know about.

If you are going to sentence a man to death, then do it. It doesn't take 20 yrs for that.

If you would want to debate about this, let the family of his victims decide. Both the direct and indirect families.

You are right the families and friends of his victims are suffering and are sadden by this, and he deserve to be punished, if you think about it he commited mass Genocide when created that gang as we killed our own. As for our tax dollars if we excuted eveybody that went into prison the government will find another way to piss away our tax money like funding a war based on false intellegence. But!! If tookie dies is the empty void that the families have are closed, or has war on ending gang violence has stopped? He may be dead on the 13 of this month, but the pain and the memory of loss will remain with the family, and the education of adolence will be lost, Laura Bush tried to talk to the kids about life as well about gang violence and if tookie dies will the kids listen to her, someone that don't know anything about the streets she can relate to minority youth? I want gang violence to end and if Tookie have to be alive to help it end then I want him to live. How many more have to die!!!

To each his own on this topic, but I have no pity for Tookie. I am glad to see that as an individual he has been able to grips with his crimes and has tried to steer others clear, but that does not change anything.

Since you want to compare this to genocide, would we be as forgiving to Hitler if he were alive and he decided to denounce his wrong doing? NO! What about Saddam? NO! Heck most of us still can't forgive George Wallace for his stand at the door to the University of Alabama, and many thing that his apologies were fake and from a dying man.

So what is the difference? Is it because he is Black? If you want to use Tookie for something, use him as a martyr. Let the youth know what really happens when you commit the crimes that he committed. You will be tried, convicted, and in some cases sentenced to death trying to show someone how hard you are.

Good post wb, and I agree with you, along with DSN. Life in prison is the biggest joke around. So what if a guy gets to spend the rest of his life in jail, big phugging deal! I don't give a dayum if they're in jail for the rest of their lives, they're still alive, and unlike those innocent lives they've taken, there families can still see them, and talk to them, and in some cases touch them.

As far as this guy goes, hey, I'm glad he used his time left on earth to try to undo some of the wrongs he's done, but again, big phuggin deal! No matter what kind of messages he gets out, how many books he writes, his children (the crips) are still killing, stealing, and dealing. They're following the example he set a long time ago, and unfortunately some of his wrongs can't be undone, because they're not following his lead now. Again, I applaud him, for trying to make things right, and hopefully the families he's wronged, have forgiven him, but it's time for him to pay his due.

Sort of makes you think, what kind of person he'd be, if he wasn't locked down for all that time. That's if someone didn't kill him first.

NICE

If he was still out there cripping in the streets instead of being locked up on death row, do you think he'd be writing children's books? Does his length of time being locked away make up for the crimes he committed or all of the lives that have been erased due to gang violence...which he co-founded?

Why not let all of the killers out of jail then...

Glad people here are comming to their senses.

I just :smh: my head at all the "glow" this killer is getting. :smh:

My people really need to take a SERIOUS look at the people we make martars out of. This shat is embarrasing. :smh:

This guy is responsiable for 4 death's DIRECTLY.................that we know of.
He is responsiable for thousands of other's INDIRECTLY with the formation of that Murdering Drug Gang "CRIPS"....................ain't that what WE are always complaining about?

Gang's, Drug's and Murder are what's crippling our "hoods" and this guy started a National franchise of the three.................. :smh:

The only thing this guy has accomplished in prison with his actions is a place in he!! that's 1 million degree's F intead of 10 million degrees F. :splat:

I agree with everyone's post it is something to think about. I don't know how or which side to go with, but i have a question not only for you all but me also. Who did God give the authority of taking ones life to? But on the other hand we are supposed to abide by the laws of the land. I also wanted to ask, who would want to spend the rest of their life in prison? There have been people to ask for the death penalty rather than life in prison. Just questions i was thinking about.

BET is doing a news special on this topic tonight I think at 7:30 pm (don't know if that is the EST or CST so it maybe at 6:30 cst).
