R. Kelly to be indicted in child pornography case

A grand jury indictment will be announced today against R. Kelly, accusing the chart-topping R&B superstar of violating child pornography laws, sources told the Sun-Times on Tuesday.

Prosecutors have a videotape sent anonymously to the Sun-Times appearing to show R. Kelly committing various sex acts with a 14-year-old girl.

State law prohibits producing or disseminating child pornography or soliciting a minor to participate in sex acts on tape or film.



The Class 1 felony charge carries a prison term of up to 15 years, and a fine of up to $100,000.

For more than three years Chicago police investigated charges that Kelly was having a sexual relationship with the then-14-year-old daughter of an associate. But the girl and her parents denied the allegations.

The Sun-Times reported the investigation in a December 2000 story about Kelly's pattern of pursuing underage girls for sex.

The big break in the case came in February when a videotape was sent anonymously to the Sun-Times. Kelly apparently made the tape of himself engaging in various sex acts--including acts involving urination with the underage girl.

The tape was turned over to the sex crimes unit of the Chicago Police. Kelly has denied having sex with underage girls and maintained in a recent TV interview that he's not the man on the tape.

Cook County State's Attorney Richard Devine impaneled a grand jury that heard dozens of witnesses identify Kelly and the teen on the tape and confirm that they had a sexual relationship.

The tape was authenticated by the FBI, which determined it could not have been a forgery. Bootleg copies of the video are available for sale on street corners across the country--$10 for VHS, $15 for DVD.

In recent years, Kelly has paid settlements to three young women who filed lawsuits or threatened to sue him over underage or coerced sexual relationships. A fourth woman has filed suit claiming Kelly coerced her into a sexual relationship when she was a minor, and he coaxed her to have an abortion. That case is pending.

Yet another lawsuit was filed by a 33-year-old dancer who charges that she was unknowingly videotaped by Kelly during sexual relations. That case also is pending.

Kelly has responded to the lawsuits by trying to tarnish the women's reputations. Before Tiffany Hawkins filed a suit she ultimately settled against Kelly, charging that he coaxed her to participate in group sex with him when she was 15, Kelly filed a preemptive suit against her for blackmail. That suit was dismissed.

This week, copies of rap sheets for minor misdemeanors that Kelly's other accusers purportedly have been charged with have been sent anonymously to local news outlets.

Kelly is hardly the first celebrity to be accused of taking advantage of young girls. Gary Glitter, Rob Lowe, Elvis Presley, Jerry Lee Lewis, Roman Polanski, Rolling Stone Bill Wyman and even the legendary Errol Flynn all have been the subject of news reports for allegedly having trysts with minors.

Chicago police interviewed dozens of people who knew Kelly, the girl in the tape or both. Because the girl and her parents denied it was her, police and prosecutors reportedly had to build the case against Kelly around them.

While police and other family members who were cooperating with the investigation grew impatient for prosecutors to charge Kelly, the Cook County state's attorney's office took months, it said, trying to make sure it had an ironclad case.

Prosecutors were haunted by a case 14 years ago, when they had a similarly uncooperative witness who had been taped having sex with a man when she was underage. Prosecutors charged him anyway, and he was acquitted.

Since then, the state's attorney's office has adopted a more aggressive stand. In 1995, Beverly Heard refused to testify that she and U.S. Rep. Mel Reynolds had sex when she was 16. They put her in jail for 13 days, until she agreed to testify. Reynolds was convicted.

In recent TV interviews, Kelly insisted that, despite the controversy over the video purporting to show him having sex with a minor, he never felt compelled to seek out or watch one of the many bootleg copies of the tape.

"If people out there have a tape of me and they're saying it's me and a young girl, a minor . . . then they're sadly mistaken or they're lying," Kelly said on BET. "I can say it with all confidence right here that it isn't me because I didn't do it. Nowadays, you can make a tape, you can make a song; it can sound like a person or look like a person . . . but that's not me."

He did not explain how a 26-minute tape in which the protagonist is seen staring into the camera and adjusting it could be faked, a feat video experts have told the Sun-Times would be difficult even for a major movie studio to pull off.

As the accusations against Kelly have mounted and the videotape of him has circulated across the country, his fellow hip-hop artists have distanced themselves from him. "Thong Song" singer Sisqo's new track, "This Is the Heart," offers the lyric, "The World's Greatest? Whatever! Ain't nothing but a child molester."

Kelly's album with rapper Jay-Z, "The Best of Both Worlds," sold far less than expected when it was released in April. Industry executives blamed the scandal. Jay-Z refused to tour, make videos or even be photographed with Kelly after the police probe was disclosed.

Rapper Nas recently told an L.A. audience, "We're not up here molesting children. We're not 'The Best of Both Worlds.' "

Multiplatinum producer Dr. Dre has decided not to release a track with Kelly. Dr. Dre was quoted in the British newspaper New Nation as saying, "I haven't seen the video, nor do I want to see it because there's a kid involved. That's where I draw the line. You can do almost anything except touch kids or something like that. That's a no-no. You know what I'm saying? If he's guilty, he's over. I'm just waiting for the results."

As the crisis has unfolded since erupting with the case of former priest John Geoghan in Boston, questions have arisen about the rate of pedophilia among priests, whether there was a link between celibacy and abuse, and whether homosexuality was a factor, since most of the victims were older boys. The church has been reluctant to authorize research on these issues in the priesthood.

Frankly, I am glad that I am not him or in his shoes.

Last week the South Park Mexican, Carlos Coy, got sentence to 45 years in prison for sex with a minor in Houston. At 31 he has to spend at least 22.5 years in prison.

Singer R. Kelly Faces Child Porn Charges

CHICAGO (Reuters) - Chart-topping rhythm and blues singer R. Kelly, the target of numerous lawsuits from women who alleged they were underage when he had sex with them, was charged on Wednesday with producing child pornography, prosecutors said.

Authorities have been studying a 26-minute videotape sent anonymously to a Chicago newspaper, copies of which have been sold on street corners, that apparently depict the 35-year-old Kelly, whose given name is Robert, engaging in sex acts with a girl.

A spokeswoman for Cook County Prosecutor Richard Devine said a grand jury handed up an indictment charging Kelly with 21 counts of producing child pornography, a felony punishable with jail time and fines.

It was not immediately known where Kelly was. Police have scheduled a press conference later on Wednesday to discuss the indictment.

Kelly, who has settled several of the lawsuits for cash, has said in interviews the videotape was a fake.

"I am not a monster that people are saying I am," Kelly told an interviewer on Black Entertainment Network television a month ago. "And if people out there have a tape of me and they're saying it's me and a young girl, a minor ... then they're sadly mistaken or they're lying. I can say with all confidence it's not me."

Kelly was discovered singing in the Chicago subways for change and became a top-selling singer and producer, writing the 1996 single "I Believe I Can Fly" for the movie "Space Jam" featuring Michael Jordan and animated characters. He has sold millions of records, and topped the charts in 2000 with "TP-2.Com."

But Kelly was shadowed by allegations and lawsuits that he was pursuing underage girls for sex, prompting informal boycotts of his records and criticisms from fellow musicians. One lawsuit claimed he impregnated a teen-ager and then coerced her to have an abortion.

Kelly first married his 15-year-old protege Aaliyah Haughton in 1994, but the marriage to the future singing star was soon annulled. She died in a plane crash in August. Kelly married a dancer in his touring group in 1996 and has two daughters and a son.

The Chicago Sun-Times, which received the videotape in February and turned it over to police, wrote a story about his alleged escapades nearly two years ago.

The child on the video and her parents need some serious counseling if they are denying that she is the girl on the tape. (Based on "alleged" confirmation from other family members) It AIN'T that much money in the world to buy me or my child's silence. When they finally come to accept this, that girl is gonna be traumatized and even scarred for life. :smh: :smh:

NastyNupe, you ain't neva lied. My child would have NEVER been at his house "alleged" recording UNLESS I had a signed deal and even then I would have been right there with her. I would have been reading a book or doing something until they finished.

And I fail to see the relevance of why the little girl was there or what her parents were doing. She can be all up in my house in my bedroom butt ass naked spread eagle in the middle of my nice burba carpet, and I would kick her little womanish ass out and tell her parents. I wouldn't screw her and put the crap on tape.

If you're dumb enough to believe that just because you told your child not to go that they wouldn't......then there are really a lot of naive people in the world. Do you really think her parents knew she was there? If your child leaves with an aunt, you wouldn't expect your aunt to take her to some grown arse man's house, but there is no way you can say 100% that your child WILL BE somewhere when you're not around. I'm sure both of you lied to your parents at least once about being somewhere and actually being in another place....let's be realistic here.:rolleyes: No parent can watch their child, especially a teenager, 24 hours of the day. Hell when you keep them on lockdown like that, thats when they go out and serve everybody up....

CHICAGO -- R&B star R. Kelly has been indicted on child pornography charges, according to a source in the Cook County State's Attorney's Office.

A grand jury charged Kelly, whose first name is Robert, with 21 counts of child pornography, said the source, who spoke on condition of anonymity.

The felony charge carries a prison term of up to 15 years, and a fine of up to $100,000.

Lawyers for the 33-year-old Chicago native did not immediately return calls to The Associated Press. Kelly has denied that the man on the tape is him.

The singer, who has worked with Michael and Janet Jackson and Celine Dion as well as rap stars, is known for hits ranging from the gospellike "I Believe I Can Fly" to sexually charged material such as "Bump 'n' Grind," "Feelin' On Yo Booty" and "Your Body's Callin'."

The Chicago Sun-Times reported in February that it had received the tape anonymously and passed it along to Chicago police, who began investigating Kelly.

The tape, which allegedly shows Kelly having sex with a minor and other sexual encounters with women, is being circulated across the country and on the Internet.

Kelly has said he has not viewed the video tape.

"I want America to know that you can't believe everything you hear, and nowadays, you can't believe everything you see," Kelly said in an interview last month on "BET Tonight with Ed Gordon."

"I've done a lot of wrong things in my life, but I'm not a criminal, I'm not a monster," he said.

Kelly also is the focus of at least four civil lawsuits, three of which accuse him of having sex with an underage girl. He has acknowledged settling two of the lawsuits regarding underage sex, but his lawyers have said they will fight the third lawsuit.

That lawsuit was filed April 29 by a woman who said Kelly had sex with her when she was a minor and forced her to have an abortion.

Kelly has said that the first two lawsuits charging underage sex had no merit. He said while he knew the women, he had no personal or professional relationships with them and only settled them on the advice of lawyers.

In the fourth lawsuit, Montina "Tina" Woods, a 33-year-old dancer, accuses Kelly of secretly taping her sexual encounter with him at his recording studio, Chicago Trax.

Kelly rose from childhood poverty on Chicago's South Side. He began singing for change at the city's L stops and went on to sell more than 23 million albums and own a mansion in a Chicago suburb.

But the scandal apparently has begun to hurt Kelly's career.

Some in Chicago have called for a boycott against his music and his joint project with rapper Jay-Z, "The Best of Both Worlds," released after the scandal broke, was a commercial disappointment.

The Sun-Times reported Wednesday that Jay-Z has refused to appear with Kelly since word that he was under investigation came out.

Kelly is married to a former dancer from his touring troupe. They have a newborn son and two young daughters.

He was briefly married to the late singer Aaliyah, who lied about her age in 1994 to get a marriage license. She was 15 at the time.

A grand jury indicted singer Robert "R." Kelly Wednesday on 21 felony counts of child pornography, according to Illinois' Cook County state attorney's office. Kelly could face a maximum sentence of 15 years in prison and a $100,000 fine if convicted, and would have to register as a sex offender.

"Even though I do not believe any of the charges are warranted, I'm grateful that I will have a chance to establish the truth about me in a court of law," Kelly said in a statement released Wednesday (June 5). "I have complete faith in our system of justice and I am confident that when all the facts come out, people will see that I'm no criminal."

Prosecutors said they will waste no time apprehending Kelly and may have him in custody as early as Thursday. A warrant has been issued for the singer's arrest. Chicago defense attorney Edward M. Genson, who's representing Kelly, said his client is currently en route to Chicago. Kelly is expected to turn himself in to authorities sometime Thursday afternoon. He is then prepared to post a $750,000 bond.

In February, a videotape of Kelly allegedly having sex with a minor was given to the Chicago Sun-Times, which in turn handed the tape over to the sex crimes unit of the Chicago police department. At a press conference Wednesday, Terry Hilliard, Superintendent of the Chicago Police Department, and Richard Devine, the Cook County state attorney, outlined the Kelly investigation and charges.

They said that after interviewing several people who identified Kelly and the girl on the tape and having the FBI verify that the tape was in fact authentic, they levied the charges. The singer faces seven counts of directing the videotaping of child pornography, seven counts of producing the video and seven counts of enticing an underage girl into illicit acts.

Devine said that Kelly knew or should have known the girl was born in September of 1984, and noted the sex acts on the tape occurred sometime between November 1997 and February of this year at a home that Kelly once owned in Chicago. The state attorney said he hopes the indictment of the singing star would send a message to sexual predators.

"It becomes a tragedy when behavior damages a community," Hilliard said. "Make no mistake ? these are very harmful crimes. The nature of these indictments returned today should also make parents more vigilant. These acts are serious crimes that involve harmful acts which damage and degrade our children, and are diminishing the integrity of our entire community."

The tape in question ? which has been bootlegged and sold across the country everywhere from the street corner and the Internet to such record stores as HMV ? features a man who resembles Kelly engaging in sexual acts with four different females in four different locations. One of the women is the minor in question.

"I should also point out, anyone that is selling this tape, as well as anyone who has purchased it, is now in possession of child pornography," Hilliard added. "It would be my advice to you to dispose of these tapes."

One of the females on the tape has come forward. On May 24, a 33-year-old dancer named Motina "Tina" Woods filed a lawsuit with the Cook County Circuit Court in Chicago for invasion of privacy. She alleges that Kelly secretly taped them having sex and is asking for $50,000 in damages (see "R. Kelly Sued By Woman Claiming To Be Sex Tape Subject").

While many of his fans and peers have seen the sex tape for which Kelly is being charged, the singer himself says he has not viewed it, and has proclaimed his innocence.

"There's things that people have done in their lives that they regret, and I'm no different," he told MTV News last month. "I'm a human being, and I want people to know that I'm no angel here but I'm no monster either. I'm no guy that would do this."

Are you having male PMS or something? These people are crucifying a man who has not been found guilty of anything in a court of law. They gave O.J. less flack than they are giving R. Kelly... I saw the evidence and it doesn't look good, but all this talk of boycotting and protesting is just ridiculous..


My R. Kelly collection is still intact....
