13-YEAR-OLD WITH ANKLE MONITOR IS SUSPECTED AS SHOOTER IN MID-CITY ARMED ROBBERY DEATH

By Rhonda Nabonne, The Times-Picayune

On the day he turned 13, an eastern New Orleans boy who already had a lengthy criminal record was found "hiding at home" just hours after he and a 15-year-old accomplice allegedly gunned down a man during an armed robbery attempt in Mid-City Tuesday afternoon. The boys are accused of killing Rafael Quintanilla, 58, as he sat on the front steps of his home in the 4000 block of Baudin Street. The 13-year-old pointed a .380 caliber pistol at him and demanded that he "give him everything," according to police. Before Quintanilla could comply, the 13-year-old shot him in the stomach and both teenagers ran from the scene, police said.

Quintanilla was brought to a nearby hospital, where he died of his wounds Tuesday night. On Wednesday, a Baudin Street resident said Quintanilla banged on his door for help after he was shot but he was already dying.

With tips from eyewitnesses, 1st District police officers apprehended the 15-year-old, who was recognizable because of his Mohawk hairstyle, police said. They later tracked down the 13-year-old, who was wearing an ankle monitor.

"This 13-year-old who celebrated his birthday by taking the life of a another human being had multiple run-ins with the law for violence, guns, curfew, theft and other crimes," New Orleans Police Superintendent Ronal Serpas said.

In a news conference Wednesday about the city's latest rash of gun violence, Serpas said he couldn't reveal the names of the juveniles or give details about their criminal records, but called the Baudin Street killing a tragedy for the city.

Serpas credited a 44-year veteran NOPD veteran and his 35-year veteran partner with getting descriptions from witnesses and tracking down the suspects. Within minutes, police said, the 15-year-old was apprehended. After he was taken into custody, he identified the 13-year-old as the triggerman who was wearing an ankle bracelet monitored by the Orleans Parish Sheriff's Office.

The second boy was found "hiding at home," Serpas said. After serving a search warrant, police found what they believe to be the weapon used in the murder, Serpas said.

Serpas said "everything quickly fell into place" for police. "Officers were able to track down the first suspect within minutes of the shooting because witnesses provided accurate descriptions of both teens," he said. He also credited Sheriff Marlin Gusman's office with being "responsive" in helping to locate the second teen.

"This was an impressive team effort, and resulted in speedy arrests," Serpas said.

In Mid-City Wednesday afternoon, Baudin Street residents talked about the crime and described Quintanilla as a friendly and generous person who often shared his food with neighbors.

Someone pushed an empty pack of cigarillos in the metal grating by the stoop where Quintanilla sat daily, smoking and greeting neighbors, and a clutch of flowers and stuffed animals lay on the corner nearby.

His neighbor, Alfredo Pinto, said he heard one shot -- "We heard the pop. Boom!" -- and Quintanilla banged on his door before staggering to the curb.

Pinto said it took rescue workers 15 minutes to arrive and that Quintanilla languished for several minutes longer and appeared to be dying before he was taken by ambulance to a hospital.

He said Quintanilla was a friendly Cuban man who was sitting on the stoop, getting ready to shave when the boys approached him and shot him in the stomach, before he could respond to their demand for anything he had.

Re: Louisiana definitely need tougher gun laws and make adults more responsible......

How will making new tougher guns laws prevented this kid from doing what he did? He wasn't supposed to have a gun...PERIOD! How about enforcing the current laws we have. This kid is a menace to society, how bout if he had been raised right then he wouldn't have done what he did.

Re: Louisiana definitely need tougher gun laws and make adults more responsible......

Tougher gun laws is not the problem. The people that use them have the problem. Where is the child's parents?

When I was growing up my dad always told me while I am under the age of 18 he is responsible for so he beat my ass if I fugged up. The parents are the problem. Again you need a test for a drivers license but everybody can have a kid.

Re: Louisiana definitely need tougher gun laws and make adults more responsible......

^Exactly! The problem with any laws is that criminals do not obey the laws. It doesn't matter how many you have.

So what do you think is going to happen to the parents????

What laws????????? Right now, the kid goes to jail probably for life for killing someone. I guess that law only works after someone is dead. What is the logic of having laws after the fact?

How about enacting a law that states if an underage child is caught with a gun or found guilty in a crime involving a gun, the custodian parent(s) shall be held liable as well as the underage child.

Mak, you must be a card carrying member of the NRA.

Jag89 help me out. I think I understand what you are trying to say but let's be honest for a minute. More than likely this kid got the gun illegally sold on the street.

Re: Louisiana definitely need tougher gun laws and make adults more responsible......

Exactly!!!!!!!!!!!!!!!!

I think we are shifting the blame on guns and not the grass roots of it all. This kid was raised by the streets....the question is how can we fix that?

How about good brothers like yourself join KAIROS which is a prison ministry that goes on the streets and in prisons to be role models for inmates and at risk youth. I'm in KAIROS...

If people can't control their kids, they shouldn't be having babies. Making parents responsible for their minor children actions, might save your life some day.

I have the right as a parent to monitor and search my minor child in my custody. Like my mother would say to me when I lived with my parents, "I must obey the rules of the house that have been provided by her and my father, but once I'm legally grown and in my own house, I can do whatever you want".

So I guess in your mind that going to the prisons to talk to people after the fact would solve the problem. Plus, I'm not blaming guns, I'm blaming the parents, which is the grass roots of these unlawful kids. Somehow I don't see your logic in actually fixing the problem.

It's interesting that you chose ONE part of the statement but given the nature of recidivism it is a start. Also, juvenile centers as well. If the parents are not helping these kids then men like yourself should step out. Not saying that you aren't but like I said you have to start someplace. I'm just not one to complain about something if I am not going to help resolve the problem.....

How does that help resolve a problem after a child kill someone and is already in prison? How can we stop them from going to jail in the first place? Being that Louisiana is the incarceration capital of world, the state definitely needs to find ways to reverse the trend of sending its’ citizens to prisons. IMO, making the parents responsible is part of the solution. Changing the mentality of those in the street or those that could end up in the street is another solution. I'm not knocking your program, because those in prison definitely need some type of rehabilitation, especially if they are going to be release someday.

Dude, it is against the LAW for a kid to have a gun!!! He was breaking the LAW when he had one in his possession. Now lets say you do enact a law where the parents of a child get charged with a kids gun crime...you then would have to enact the same laws for when a kid sets a fire and commits arson....gets behind the wheel of a car drunk and kills somebody. Why just guns? Why not knives and any other weapon a child uses to kill somebody? That would never fly, because people are not raising their damned kids. As I stated before the kid broke the law by the virtue of having a gun in his possession.

This topic is confusing as hell. What does gun laws have to do with this kid getting a gun

Why not???? If guns are creating the most murders. I'm sure any gun can be traced back to its rightful owner. Hell, you were an officer in the military and you of all people should know if anyone lost an M-16 while on a training exercise, nobody leaves until that M-16 is found. Why states can't enact laws making gun owners and parents responsible for guns in their possession or children possession?

Why just guns then? Why not make parent's responsible for everything in their kid's possession. Drugs, Knives, Guns, Porn....all that stuff! Here's something better for you to do. Why not go out and get a petition passed to put such laws on the books. Go ahead, since you are so concerned.

You're going off the deep end on this one 89.

So should we hold parents accountable for pregnancy and make them pay child support, bad grades and fine them, fights at schools and have them do jail time?

C'mon dude, take a deep breath and say woo sas...

That's just it. The State of Louisiana has made it too easy for minors to get guns, because the state refused to make gun owners more responsible for the guns in their possession. If you're going to own a gun, it shall be your responsibility to see to it that it does not fall in the hands of someone illegally. Louisiana is like the wild wild west. Everybody is packing and if one person say one thing wrong, somebody getting shot, which is the main reason why Louisiana murder rate is the nation's highest.

Well, the state does make most father pay child support.

Does the death penalty prevent murders?
