Former NCCU Football Coach Henry Frazier III Sues University, Seeks Reinstatement

Former North Carolina Central University head football coach Henry Frazier III is suing the university for breach of contract stemming from his August 2013 firing from the school.

According to the Independent Weekly, Frazier’s April filings in Durham Superior Court allege wrongful discharge and breach of contract, and specifically cites a section of his contract with NCCU, “Any discipline under this subsection shall not violate the due process rights of Coach to defend himself against false and/or malicious prosecution or accusations.â€￾

Spears won his wrongful termination law suits on two occasions.
It never ceases to amaze me how these universities make these personnel decisions without considering a persons due process.
 
Filing a law suite is not a hap-hazard matter. You have to be deliberate and make certain all of your ducks are in a row. Not getting another coaching job may have something to do with it but that only solidifies his action. He can show damages which may get him a larger award.

I'm just saying he wasn't so interested in suing them last year when he was found not guilty of the charges that got him fired. He didn't seem interested when he was applying for all the vacant head coaching jobs that was out there that he didn't get. Although he did appeal to get his job backlast year, he was not successful in doing so. His option now is basically for monetary reasons and nothing more. He should be successful in doing that but other than that, his chances of getting that job back seems null & void.

Here's a thought. Maybe his attorneys were trying to negotiate an out of court settlement and it's to the point that all negotiating has been exhausted, so they brought it to the next logical step.

No, he will not get his job back. But he will receive some compensation.
Ask Coach Spears (GSU & Alcorn) and even the former A.D. at SU.

Of course not but he still has to show an effort of attempting to demand for his job back. It's all legal strategy that he must do. JCole had to do the same even though he knew it was no way in hell he'd get the job back.
