Can Phat Beats be Copy Righted?

Is a rhythm or beat that someone originates interlectual property? Take that track by Alicia Keys, "Karma" for example. (speaking of dat chick, what's her story? is she black, hispanic, mixed or what? where da fugg she from? Jelli send help.) The drum brake in that track is a classic hip-hop type of track. (who originated dat shat by the way? was it Ice Cube? Black Moon, Smith & Wessen? KRS-One? Sugarhill? dunno.) Is that interlectual property? Should it be?

Yes and Yes....

Remember Vanilla Ice got sued by David Bowie and lost about the rhythms he stole. They were on David Bowie's "Under Pressure" song and he did not get permission to use them.

Samples have to be cleared. Interpolations are basically remakes and involve payment also. Using some of the same instrumentation does not mean you are copying. There are thresholds below which no payment is required.

Alicia Keys is of mixed race (mother white/ father ??? assumed black) ...

Not so sure about actual royalties, but the use of the sample did have to be cleared to prevent a potential lawsuit.

Plus, I don't even know if AWB even owns the publishing of their stuff anymore. :confused:

probably not. do they even exist now days? And what about Blackmoon doing that track "Who Got Da Props" which is straight from Ronnie Law's "Tidal Wave"??? you know,, RLaws man,, what a mutha-fickin' classic alltime artist DAT mug,, oh my goodness,, but for Blackmoon to bite Laws,, oh man,, did they come up wit dat or a producer of theirs??? great, great, great classic alltime stuff although Bmoon was a flash in the pan.

"Tidal Wave" is the JOINT! (was playing it in the car yesterday on my way to an afterwork gathering). Be honest though...not everyone was up on Ronnie Laws, so for Blackmoon to use THAT song as a Sample (not a bite...BIG difference ;)), was pure genius!
A lot better than that isht Puffy does all the time...:rolleyes:

To me, that's what makes sampling an art!
For a producer/dj to take an unconventional piece of a song/soundbite and use it in a way to make a hellified track...:eek:

When I first heard "Who Got Da Props" in undergrad, I used to go crazy when DJ Smurf would play it at the parties!

It wasn't until years later that I found out that it was Ronnie Laws who provided that sample.
Nowadays, I'm a Sample Fiend! :lol: I make it a point to hunt down the ORIGINAL cuts that my favorite samples come from.

I wouldn't consider Black Moon a flash in the pan though...;)

Remember, Buckshot and nem got with Boot Camp Click and sustained a more underground following. :)

And you know, I thought I was THE ONLY ONE trying to find every original track of the sampled hip-hop! Some stuff I already had, like Joni Mitchell, so when Janet did "Got Till It's Gone" and there was all that hype, i was like :rolleyes: ,,, give me a break. Joni FREAKING Mitchell is a CLASSIC as is that track,, but yeah Janet was aight on that one.

There are so many that I found,, can't think of them now but will come back to this thread as I come across them.

Now one group/cut dat I have not been able to find to this day and when i hear this song in the collection I still go crazy is Brand Nubian's "Punks Jump Up To Get Beat Down"!!!! :jump: now my friend, if you can tell me who they sampled DAT ***** from,,,,, OOOOOOOOOOOOH MY GOODNESS!!! I'LL BE FOREVER BEHOLDIN' TO YA!!! :nod: i mean,, DAT WAS MY *****!! Did they sample that or is that original?!

I am curious to see what original tunes 9th Wonder used for samples. Like Little Brother's "I'm Loving It", the sample was from the Stylistics (sorry the name escapes me).

Me too... whenever I hear a sampled song today.. or an older song that I like... I find the artist that they sampled and usually download it....

I dont even remember how I found out the sample to Method Man and Redman's "How High"... but once I did, I bumped it... I know when I was working at the casinos in Tunica, thats all that they played was ol school music... I usually could pick up a lot of the tracks after listening to it for a few seconds....

I also liked how Three 6 Mafia released an unofficial double CD of all the tracks that they have sampled... it is quite nice...

That original is on my list, too! :lmao:

The PRIMARY sample in that song is taken from Lou Donaldson's remake of "It's Your Thing", by the Isley Brothers. :cool::tup:

There's some James Brown up in there somewhere, too...:)

To be honest, I DO like Brand Nubian's usage of it more than I like the original song.
 
yup, yup! and dude,, i don't know if this was a sample, but what about that cut "Sally Got a One Track Mind"? OOOOH MY GOOOOOODNESS!!! :) Man, that was my song there!! And then there's Guru/Gang Star! DAT brotha got so much classic sampled hsit it ain't funny! and have you heard that group Dekah(?) their cuts Gangstarr Variations??!!! oh my stinking goodness!!!
