Bellaire officer panicked before shooting former PV ball player, prosecutors say

It may not have been racial but some crooked azz cops are so quick to write and it showed now why one of the mofos are about to pay the price. How the hell you run the wrong license plate?

I have entered several comments in response to this story. To be honest, I really don't think race played as big a role in this incident as some would like to believe. But I DO believe that the officer(s) involved are very guilty of a series of errors and lapses in judgement. If they truly believed they were about to execute a felony arrest, why did the initial officer (after running the wrong plate) not exit his vehicle with the emergency lights on? What felony stop is executed in a driveway at 2 AM where the officer just jumps out of the car with a flahlight and gun pointed?

Think about that situation where the cop entered one single character wrong and it had a hit as a stolen vehicle. Could've EASILY happened or could happen to any of us.

Now think... what would you do if an officer draws his weapon and orders you to the ground? Do you comply and hope the wheels of justice prevails and it's later found that your vehicle was indeed good where you'll get the infamous public apology? Or, do you childishly throw a temper tantrum w/ someone w/ a loaded weapon pointed @ your dome, who's been trained to shoot to kill, and make a bad situation worse?

There are only 2 sides to take. :read: I know what the jury will do to quell the uprising though. There's plenty of fault to be metted. Sometimes it's best to draw a strong line between emotionalism and intelligence. The more emotional one is, the less intelligent (non-thinking) one becomes. :read:

P,
You are absolutely right. And according to all accounts, as angry as the young men may have been, they complied with all the reasonable requests of the officers. The event that initiated the escalation of this incident was the officer in question slamming the young man's mom into a wall as she was 1) attempting to point out the officers' error, and 2) cursing at her son and pleading with him to continue to follow the orders.

Had the mom never been manhandled, this incident likely would have had a happy ending for all involved. Tolan would have been inconvenienced by the erroneous stop, but would be without bullet in liver.

THAT, mes amie, is where the focal point of contention started! Emotional mother. :read: I'm not faulting the young man because NONE of us males in this forum would sit idly by and watch our mom get manhandled by ANY man, let alone a white male even if the white male had a nuclear weapon pointed @ us.

Mother should've used MUCH, MUCH, MUCH better judgement. Handcuffed them? Okay. Show paperwork AFTER they put their guns up and the situation calms down so intelligent reasoning could hopefully occur.

I used to get pulled over so much until it hurts but I took it w/ a grain of salt. Had the po-pos called on me once as they had a 911 call that a black man was breaking into a Porsche one morning. lol :emlaugh: I'd just gotten the thing and the alarm was going off and I forgot how to deactivate it. So, I was in it and then out and then back in and then out because the key to turn the alarm off was on the outside in a separate keyhole. :emlaugh: Po-pos pulled up, weapons drawn, I was placed in handcuffs, sat in the rear seat while they looked my license and registration from the crib over. Took all of 45-50mins though. Thought they were really gonna' take me in as they questioned why or how I had the keys to the vehicle. lol (now that was racial-Pickerington, OH)

And all that is great. I believe this incident could have ended up the same way. The mom wasn't even talking to the officers. She was hollering at her son and his cousin to continue to obey the police officers, and for that, she was roughed up. Now, had Tolan been TASED, then the sequence of events that played out could have been better justified. But a slug in the liver based on the events that ACTUALLY played out is a bit much for me to understand.

I had the wrong image. I thought the mother was showing hostility towards the officers.

I cannot grasp how all that went down. It was all so wrong from the very start and ended up much, much more wrong. Not sure if I'd pin the racist tag on the officer but he (and they) certainly deserve the stupid and idiot tags.

Tolan was leaving work and the two stopped at a fast-food restaurant on the way home. After he saw them make a “quick†turn, Edwards followed as they parked on the street, he said.

Edwards told jurors he entered the wrong license plate while driving by the two men, who were parked and rummaging in the back seat of the black Nissan sport utility vehicle.

Moments later, the license plate number he ran—with one number wrong—came back as stolen. The stolen vehicle also was a black Nissan with four doors. It was one model year off from Tolan's sport utility vehicle.
Chaotic scene

Edwards circled back to see Tolan and his cousin walking up the driveway to their house with a brown paper bag. Testimony showed the bag contained a bottle of vodka and a soda. Edwards said he got out of his patrol car, gun drawn, and told the two to lie down on the pavement.

The police officer testified that both men shouted profanity, disagreeing with him.

Tolan's parents then emerged from the house and yelled profanely at the two men to listen to Edwards.

“The scene was in no way under control,†Edwards testified.

Greenwood told the jury that seconds later, Cotton arrived and ended up “manhandling†Tolan's mother as the two officers panicked.

Aman told jurors that as Tolan and his family protested that the car was theirs and the two men lived there, Tolan's mother told Cotton, “Take your hands off of me!†Tolan then said, “Get your hands off of my mother!†Aman said.

As Cotton tried to move the woman, Tolan rose from the ground. Cotton fired three times, hitting him in the chest once.

Edwards testified Tolan “appeared to be charging or rushing†Cotton.
======

Stupid and idiot seem to fit very well here.

I was on the jury panel for this case on tuesday. Didn't get selected. Neither did any of the other black males.

So how many angry unarmed white citizens do they shoot for throwing a temper tantrum and defending their mother?

As far as I can see, it's been nothing but blacks and look-a-like blacks that's been at the end of a barrel in good ole Texas, but I sure the good white citizens of the state would never do anything like that and just comply without even a question let alone thrown a temper tantrum for being stop under the suspicion in their own driveway.

The African American population of Bellaire is not great. In addition this young man was a high school star on the Bellaire baseball team. Again not that many African Americans on the team. The father was a major league star. Bellaire p.d. has a horrible record in reference to its race based arrests.

Even if he was charging the officer, if he did not have a weapon, I do not think the use of deadly force was warranted.

Now think... what would you do if an officer draws his weapon and orders you to the ground? Do you comply and hope the wheels of justice prevails and it's later found that your vehicle was indeed good where you'll get the infamous public apology? Hey, I live in Texas...home of the judicial itchy trigger finger.

"Ahh...yes'suu. Where would be the best place to put my hands, so you can place thine steel bracelets upon thee?"

The one thing that they keep saying is that he ran the wrong number and it gave him a similar vehicle and the same color. No where have they even stated what plate number he actually ran and verified that this vehicle was indeed reported stolen. His story don't add up becuase when you do get a "hit" on a stolen vehicle. It will give you the year, make and color, it will also state whether it is a truck or car. They keep saying 4dr nissan which makes me think it was a car and not a suv.

According to the many cops posting comments on the story yesterday and the new story this morning, the only info that comes back when a plate is run is the make. Matter of fact.....here is a direct quote from a cop...

"I will try this one more time... when a vehicle is run... the only info on the vehicle that we get back is the make... not the model or color or any other identifiable markers... and since dealerships typically go get vehicles registered "en mass"... it is very possible that by being one number off... you get the same make of vehicle... just fyi... "

But different model years also?

I read that too and he is incorrect. I've entered plenty of stolen vehicles into the system and you do have to put the model and color in it along with misc info. When it gives you a hit, you get the year, make and color and whatever misc info that was entered along with the entering agency and their info. He went on to say that it may take 10 min to a hour to get a reply, again he was incorrect on that statement. You will get the return back quick and all the information about the vehicle, but it may take 10 min and up to get confirmation from the entering agency when you send them the Admin Message about it.

Thanks for the clarification. It just kills me how many people over there are saying it's either his or his mother's fault that he has to wear a bullet for the rest of his life.
