I don't think this is an accurate list. Grambling is not on the list. Southern and PV are not on the list either.

I was wondering the same thing, and after perusing several links on the U. S. News & World Report website, I couldn't find a definitive answer. This page:

does offer some insight into how they ranked the schools, in general. It doesn't, however, indicate the difference between Tier 1 and Tier 2 schools.

They clearly explain how a school was determined to be unranked, but not the difference between Tier 1 and Tier 2.

I just submitted a letter to the editor asking for more clarification on this issue.
 
I'm thinking the difference between Tier 1 and Tier 2 not only factors in the criteria the used to rank schools, but the major thing for the division of categories is the Peer Assessment Score (reputation). That is basically the opinion of what other universities think of your institution. The higher scores go into Tier 1, and the lower scores go into Tier 2.
 
I finally received a response from my query and it did not answer the question, nor tell me anything more about the difference between Tier 1 and Tier 2 schools.

Schools that are number ranked are the best schools. Schools in tier 2 did not do as well.
