Man Forced To Pay Support Despite DNA Evidence

A new state law says men no longer have to make child support payments if they discover the child is not theirs, but a Houston man says he still has to pay.

Ray Thomas contacted KHOU 11 News saying he is frustrated because he owes more than $50,000, even though he is not the child’s father.

“They've been taking money out of my income tax -- taking my money and I haven't been able to pay my bills,â€￾ Thomas said.

Thomas claims he's a victim of mistaken paternity.

He said, in 1986 a woman he was dating had a baby and told Thomas it was his. In fact, he thought so too until the little girl's hair started to turn red. Thomas said he went to court numerous times trying to clear things up, but said the judge wouldn't hear it.

This year, the Texas Legislature unanimously voted to change the law. It is already on the books. DNA proof can reverse parental rights.

“And now with the passing of this law, a man who is not the father can now sort of be free of that title and the proper man can be put into place to establish that relationship,â€￾ she said.

But we learned the new legislation will not help Thomas because his case is old and the courts are looking not backward, but forward.

This is why I think all children should be DNA tested at birth.

last time that discussion was had, certain people was like "I wish my man would ask for that." :lol:
I ain't taking no chances. With all the undercover cheating going on, no way I'll let some biased court or child services agency get me on the hook for a kid that is not positively MINE.

As you can see by this story and all the ones posted in the past, child services and the judges who preside over it don't care who they get a check out of just as long as some man pay. :smh:

A lot of states are actually implementing this as law now. And regardless of the crutch many women will use called "trust", if there are no doubts there should be no issues.

A relative of mine always used to say, 'if you can't see yourself having a child with that person, don't sleep with them."


The courts are going to do what they think is in the best interest of the child--- NOT the parents/adults. And if that means, a man has been paying child support all along and later finds out the child isn't his, the CS may continue at the judge's discretion or until a person can find the right father. If the right father isn't found, the CS will continue, because the courts sees it as a form of support forthat child. And they are not going to take support away from a child when there is nothing to replace it or fall back on.

This would make sense in a perfect world, but a perfect world this isnt. There have been PLENTY of people that "thought" that they had no reason to doubt their mate that found out years later that they shouldve. Just because I trust you and dont doubt that a child we have together is mine doesnt make it true. There's cases popping up every week where men didnt "doubt" and found out later that they werent the father.

Me trusting someone or the situation doesnt necessarily make that person any less triflin. I mean im sure most people that get married dont think their mate will cheat on them either but how many divorces stem from affairs? There arent always signs and sometimes you just never know until it happens.

It still applies, because more often than not, people sleep with and have kids with people they're not serious about and then have serious doubts about kids being theirs.

I don't have an issue of it being a routine procedure. I'm finished having kids. *knock on wood* And there's no denying that my son looks like his father; he looks like he gave birth to him instead of me. :lol:

It wouldn't apply to me either. My daughter is definitely mine and my last child support payment is due this month. I'm done. No more kids for me. :)

I just feel bad for men who have been fooled and are forced to pay anyway. I think that is unjust.

My question is as a man if you not married why would u not get a DNA test

Because your woman would guilt trip you to death. "Oh you dont trust me?" "Why would you think he's not yours?" Man that would be a disaster. If it was me and I was going to do it she'd never know it unless the results came back showing the child wasnt mine. But if you actually tell her you want to do it, you're going to catch hell regardless.

Rich dudes dont have a problem asking for a prenup then u shouldnt have a problem asking for a dna test. Most of the cases the people were just fukking around, fukk buddies. if you get a girl pregant and yall just fukking and dont get a dna test then thats yo dumb ass

If this was law, the guy mentioned in the story would not be going through the hell he going through now. The real father would have been "dimed" on by the mother as soon as that test came back marked "Not the father".

Basically, a lot of these women don't know who the father of the child is or the father is worthless.

So, since the state doesn't want to pay for the child, the state and women collude to pin it on a good guy sucker. Whether that be the misguided husband or another sucker. As long as somebody pays regardless of whether it's fair or not.

That's why mandatory testing at birth is "wrong" to many women and politicians. :shame:

Again another excuse. Take the DNA test. If a man dont protect himself and dont take the test he has no one to blame but himself.

I've seen cases where the man (especially a husband) didn't want a DNA test.
To some men, having a kid gives them a sense of accomplishment
and it can be too painful (especially for a husband) to find out the kid(s) are not his.
