The former president of Alabama State University is suing to get his severance package, which includes $289,000.
Joe A. Lee, whose resignation became official May 31, filed a lawsuit Monday in Montgomery County Circuit Court.
In court documents, Lee claims breach of contract by the university and seeks dismissal of a lawsuit filed last week by ASU trustees Joe Reed and Thomas Figures that succeeded in temporarily halting Lee's severance package.
The trustees contend the severance package would violate the Alabama Constitution, which prohibits a state entity from issuing payments when no work has been done.
On Friday, Judge William Shashy granted the request by Reed and Figures to stop any payment to Lee. Shashy, however, offered no decision on the legality of the trustees' claim, but ordered all parties into mediation within the week. Mediation has been set for Thursday, according to W. Troy Massey, Lee's attorney.
Reed and Figures want Lee to continue as president until the board selects a replacement or until his contract expires on Aug. 31, 2009.
